Open and Close Pool Service, LLC, offers its customers service on almost all areas of pool service. Below is a contract for services for 2012. Please fill out this contract to sign up for a pool opening, weekly pool maintenance, and pool closing. The contract allows you to pick only which services you want performed and is valid through October 31, 2012.

In addition to the content in the contract we would like to provide the following points that we feel are important to our customers:

1. All our employees have an ID card, wear a uniform, and will be driving a fully equipped vehicle bearing our company logo on each visit to your home.

2. All employees are subject to a thorough background check through www.beenverified.com

3. All water tests are performed on site using a Lamotte Water Link Express Testing Unit. This is the same testing unit you will find in most pools stores. These units are installed on all our trucks. This unit is the best residential testing unit on the market today.

4. Immediately after every service you will receive an email that tells you when we were at your house, what your chemical readings were, what chemicals were put in your pool, and if there are any issues you need to be made aware of (gate not closing properly, pump getting noisy, etc.)

5. You will be given access to a homeowner’s portal which allows you to access your account. Information on the portal will include a summary of all service and a list of all your pool and spa equipment.

6. All service calls are billed in ¼ hour increments and there is no one hour minimum.

Pool Opening

Pool opening consists of removal of cover, lowering of anchors as to be flush with ground, removal of all plugs, and reattachment of all fittings, rails, ladders, and diving boards. Filter is prepared for use by placing all plugs and gaskets back on filter. If customer has a heater the heater is prepared for use by placing all plugs and gaskets back on heater. Gas valve is turned on, pilot light is lit, if applicable, and heater is tested for service. If heater does not fire due to a mechanical problem, a service call must be scheduled and customer will be billed the prevailing service rate plus all necessary parts. The pools’ pump will be primed and turned on. Pool water will be tested and adjusted to a free chlorine reading of 1-3ppm and a pH reading of 7.2-7.8.

Customer agrees to have pool cover free of any water or debris and have cover bag and all necessary fittings placed by pool or within easy access for Contractor. Any missing equipment needed to open pool will be provided by contractor and added to opening bill.

Customer also agrees to the following fees:

Return Call Fee - A $75 fee will be added to the opening cost if Contractor cannot start up pool due to water level too low or any necessary equipment is missing, Contractor cannot gain access to pool, or pool cannot be opened for any reason outside of Contractors control (Electricity turned off, dog in yard, etc.)

Open spa attached to pool(shares same equipment) – $50

2012 Opening Prices

Additional Services

Weekly Pool Service consists of water testing, treatment, and adjustment for the following parameters: Total Chlorine, Free Available Chlorine, pH, Total Alkalinity, Cyanuric Acid (also known as stabilizer or conditioner), Calcium, Iron, and Copper. These parameters will be maintained in accordance with the Langlier Saturation Index, an industry-wide accepted measurement of water balance. A maintenance dose of Clarifier, Algaecide, and Metal Out will be added on every visit. Service will be performed on the same day each week. Customer agrees to allow all Contractor employees access to their property to perform all related pool work. All other unique problems such as black algae, pink or yellow algae, phosphates, etc. are not covered under this agreement and will be treated by Contractor after a mutually agreed upon price and schedule for treatment between Contractor and Customer.

Additionally, during each Chemical Maintenance visit Contractor will place a new skimmer sock in all pool skimmers, skim pool surface as needed, and check and empty and clean pump basket as needed. Contractor will also check filter pressure and backwash as needed.

Price for weekly service - $29 per visit plus all chemicals and supplies

Pool vacuumed with independent pump and filter which contractor will bring each visit. Pool walls brushed prior to each vacuuming.

Pool closing consists of lowering pool level, removing all fittings, rails, ladders and diving boards. All lines are blown out and capped in the pool so as to have no water in the pool lines running from the filter area to the pool. All plugs are removed from the filter and all other equipment pad items such as polaris, heater, etc. All such equipment is drained so as to have no water in them. Timer box and gas line to heater, if applicable, are then shut off and Customers cover is placed on customer’s pool. Pool water will be tested and adjusted to a free chlorine reading of 1-3ppm and a pH reading of 7.2-7.8.

Customer also agrees to the following fees:

Return Call Fee - A $75 fee will be added to the closing cost if Contractor cannot close pool and has to reschedule because Contractor cannot gain access to pool, or pool cannot be opened for any reason outside of Contractors control (Electricity turned off, dog in yard, etc.)

All customers who have signed up for an opening, weekly service and a closing are entitled to a 10% discount on their opening, closing, and weekly service bill. In addition, they are also entitled to a 10% discount on all service call and heater service call labor costs.

Service Calls

All work performed (with the exception for heater service) for the 2012 season that is not covered under the above terms of the will be billed at $99 per hour, plus parts. This rate is billed in quarter-hour increments and there is no one hour minimum.


Heater Service Call

All heater service calls will be billed at $125 per hour, plus parts. This rate is billed in quarter-hour increments and there is no one hour minimum.


Terms of Payment

Contractor shall be paid on or prior to the 15th of the month for the previous month’s service. Contractor will send out invoices at the end of each month for all work performed.


Late Fees

Late payments by Customer shall be subject to late penalty fees of 1.5% per month from the due date until the amount is paid. Contractor will stop service if payment is over 15 days past due.


Equipment and Supplies

Contractor, at Contractor's expense, will provide all equipment and tools necessary to perform the contractual services.


Expenses

Contractor will be responsible for all expenses required for the performance of the contractual services.


Terminating the Agreement

This agreement will become effective when signed by both parties and will terminate on October 31, 2012 or the date Contractor completes the services required by this Agreement or the date a party terminates the Agreement as provided below. With reasonable cause, either party may terminate this Agreement effective immediately by giving written notice of termination for cause. Reasonable cause includes:

  • A material violation of this Agreement, or
  • Customer's failure to pay Contractor's fees as provided in this agreement, where Contractor has demanded payment, in writing, and has not received payment at least 10 days after the date that such demand was sent to Customer.
  • In addition, either party may terminate this Agreement at any time by giving 10 days written notice of termination.


    State Sales Tax

    Contractor is required to collect N.J. Sales Tax of 7% on all services performed.
